Welcome to FUTIQA. The terms “we,” “us,” and “our” refer to FUTIQA.

FUTIQA operates this website and online store, including its information, content, features, tools, products, and related services, to provide customers with an online shopping experience collectively referred to as the “Services.”

Our store is hosted by Shopify, which provides the ecommerce platform that enables us to offer the Services.

These Terms of Service, together with any policies referenced in them, explain your rights and responsibilities when accessing or using the Services.

Product descriptions, specifications, prices, and availability may be changed without notice. We may discontinue a product or limit the quantity available to any customer, location, or jurisdiction.

Product packaging, components, manuals, or accessories may differ slightly from website images when a manufacturer updates a product without materially changing its intended function.

We do not guarantee that every product will meet personal preferences or expectations. This does not limit rights available under our Return and Refund Policy or applicable law.

Section 3 — Product Safety and Proper Use

Customers are responsible for reading and following all manufacturer instructions, safety warnings, assembly instructions, maintenance requirements, and operating guidance included with a product.

Outdoor cooking products must be used only for their intended purpose and in an appropriate, properly ventilated location. Products labeled for outdoor use must not be operated indoors or in an enclosed space.

Customers must follow all applicable safety requirements regarding heat, fire, charcoal, gas, fuel, electricity, ventilation, children, pets, and combustible materials.

FUTIQA is not responsible for damage caused by misuse, improper installation, unauthorized modification, failure to follow manufacturer instructions, or use of a product for an unintended purpose, except where responsibility cannot legally be excluded.

Section 4 — Orders

Submitting an order constitutes an offer to purchase products from FUTIQA.

An automated order confirmation does not necessarily mean that an order has been finally accepted. We reserve the right to accept, reject, limit, or cancel an order for legitimate reasons, including:

  • Product unavailability.
  • Incorrect pricing or product information.
  • Suspected fraud or unauthorized payment.
  • Shipping restrictions.
  • Unusual order quantities.
  • Technical or inventory errors.

If we reject or cancel an order after payment has been collected, we will issue an appropriate refund to the original payment method.

Please review your order carefully before submitting it. If you need to request a cancellation or correction, contact us promptly at support@futiqa.shop. We cannot guarantee that changes or cancellations can be completed after an order has entered processing or shipped.

Section 5 — Prices, Payments, and Billing

Prices, discounts, offers, and promotions may change without notice.

The price charged will be the price displayed when the order is submitted, subject to correction of clear pricing or technical errors.

Unless expressly stated otherwise, displayed prices do not include applicable sales taxes. Taxes and any other applicable charges will be shown during checkout.

FUTIQA currently offers free standard shipping on eligible orders delivered within the United States, subject to our Shipping Policy:

You agree to provide accurate and complete billing, payment, and contact information.

By submitting payment information, you represent that:

  • The information is accurate and complete.
  • You are authorized to use the selected payment method.
  • The payment provider may process the applicable charges.
  • You will pay all valid charges associated with the order.

Section 6 — Shipping and Delivery

FUTIQA currently ships to eligible addresses within the United States only.

Order-processing and estimated delivery times are explained in our Shipping Policy. Delivery dates are estimates and cannot be guaranteed.

Delays may occur because of carrier disruptions, weather, holidays, high order volumes, incorrect shipping information, or circumstances beyond our reasonable control.

Customers are responsible for providing a complete and accurate delivery address. Address corrections and order changes cannot be guaranteed after an order has been submitted.

If an order is significantly delayed, appears to be lost, or arrives damaged, contact support@futiqa.shop.

Nothing in this section limits rights provided by applicable law or our published Shipping and Return and Refund Policies.

Section 7 — Returns and Refunds

Eligible products may be returned in accordance with our Return and Refund Policy:

Products returned without prior authorization may not be accepted.

If a product becomes unavailable after an order is submitted, we may cancel the affected product and issue an appropriate refund.

We are not obligated to restock a discontinued or unavailable product.

Shopify and its associated names, logos, products, and services are trademarks of Shopify or its affiliates.

We do not control every third-party service and provide access to such services on an “as available” basis.

Your use of a third-party service may be subject to that provider’s separate terms and privacy practices. You should review those terms before using the service.

We are not responsible for a third-party service to the extent permitted by applicable law.

We do not control and are not responsible for the content, accuracy, availability, policies, security, products, or services offered through external websites.

Accessing a third-party website is at your discretion. Before completing a transaction with a third party, review its applicable terms, privacy policy, return policy, and business practices.

Questions or complaints concerning a third-party service should be directed to the relevant provider.

Section 12 — Relationship With Shopify

Our store is powered by Shopify. However, purchases made through our store are transactions between the customer and FUTIQA.

Shopify provides the ecommerce platform but is not the seller of products offered by FUTIQA.

To the extent permitted by law, Shopify is not responsible for product fulfillment, customer service, returns, refunds, product performance, or transactions between customers and FUTIQA.

We are not obligated to keep feedback confidential, compensate the person submitting it, or respond to it.

The Services may occasionally contain typographical errors, inaccurate information, or omissions relating to product descriptions, prices, promotions, availability, shipping charges, or delivery estimates.

We may correct errors, update information, or cancel an affected order when reasonably necessary.

If an order is cancelled after payment because of an error, an appropriate refund will be issued to the original payment method.

Termination does not remove payment obligations or other responsibilities incurred before the termination date.

Provisions that are intended by their nature to survive termination will remain effective.

Section 18 — Disclaimer of Warranties

Except as expressly stated in our policies, product documentation, or required by applicable law, the Services are provided on an “as available” basis.

We do not guarantee that:

  • The Services will always be uninterrupted or error-free.
  • Every website error will be corrected immediately.
  • Product availability will remain unchanged.
  • A product will meet every personal preference or expectation.

Some products may be covered by a manufacturer’s warranty. Any manufacturer warranty is subject to the manufacturer’s applicable conditions.

Nothing in these Terms excludes warranties, remedies, or consumer rights that cannot legally be excluded.

Section 19 — Limitation of Liability

To the fullest extent permitted by applicable law, FUTIQA and its officers, employees, affiliates, contractors, service providers, and licensors will not be liable for indirect, incidental, special, punitive, or consequential damages arising from the use of the Services.

This may include loss of profits, revenue, data, savings, business opportunity, or replacement costs.

Nothing in these Terms excludes or limits liability that cannot legally be excluded, including liability arising from fraud, willful misconduct, gross negligence where applicable, or other legally protected consumer rights.

Section 20 — Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless FUTIQA, Shopify, and their respective affiliates, officers, employees, contractors, licensors, and service providers from third-party claims arising from:

  • Your material violation of these Terms.
  • Your unlawful use of the Services.
  • Your violation of another person’s rights.
  • Content that you submit through the Services.

This obligation does not apply to the extent a claim results from FUTIQA’s own unlawful conduct or responsibility that cannot legally be excluded.

Section 21 — Severability

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent legally permitted.

The unenforceable portion will be treated as separated from the remaining Terms, and the remaining provisions will continue in effect.

A failure by FUTIQA to enforce a provision of these Terms does not waive the right to enforce that provision later.

These Terms and the policies referenced in them constitute the entire agreement concerning use of the Services and replace prior communications or agreements relating to the same subject.

Section 23 — Assignment

You may not transfer or assign your rights or obligations under these Terms without our prior written consent.

FUTIQA may transfer its rights and obligations as part of a business transfer, restructuring, merger, acquisition, or sale, subject to applicable law.

Section 24 — Governing Law

These Terms and any separate agreements through which we provide the Services will be governed by the laws of the State of Illinois, without regard to its conflict-of-law principles.

Any legal proceeding relating to these Terms will be brought before a state or federal court having jurisdiction in Illinois, except where applicable law permits or requires otherwise.

We may update these Terms when our Services, business practices, or legal obligations change.

The current version will be published on this page with an updated revision date.
